In July 2026 the NSW Government released its Asbestos Plan of Action, and the EPA is now developing formal material acceptance, inspection, sampling and analysis guidelines for asbestos in recovered materials. What was once a paperwork exercise is becoming a documented inspection regime, and the businesses with robust testing already in place will be the ones that keep supplying without interruption.

What are the Rules for Asbestos in Recovered Materials?

NSW takes a zero-tolerance approach. Under section 144AAB of the Protection of the Environment Operations Act it is an offence to reuse or recycle asbestos waste in any form, at any concentration, and asbestos waste cannot be processed, screened or segregated out. Resource recovery orders for recovered aggregate and recovered fines sit on top of that, requiring suppliers to prepare written sampling plans, test at set frequencies and analyse for asbestos using approved methods, including qualitative and quantitative analysis to AS 4964.

The framework is now changing. Following the Chief Scientist’s review of asbestos in recovered fines and materials, the NSW Government’s July 2026 Asbestos Plan of Action supports a through-chain, risk-based approach with a proposed threshold of no visible asbestos containing material, less than 10 mg/kg total asbestos, and no asbestos detected using AS 5370. The EPA is consulting with industry on material acceptance, inspection, sampling and analysis guidelines to give effect to it.

For recyclers and suppliers, the practical message is simple: documented inspection and testing is moving from good practice to expected practice. What are the Risks of Getting Recovered Materials Wrong?

For a recycling business, asbestos in product isn’t one problem. It’s five at once.

• Zero-tolerance offences, supplying material containing asbestos at any concentration is an offence under the POEO Act, regardless of intent, with penalties that can reach into the millions for corporations.
• Licence and order conditions, failed inspection can put your environment protection licence and your resource recovery order at risk, and without the order, the material you produce is legally waste, not product.
• Product recall and rejected loads, if asbestos is found after supply, affected material may need to be traced, recovered and disposed of as asbestos waste, at your cost, from sites you no longer control.
• Land contamination liability, recovered fines applied to land that later test positive can trigger contaminated land obligations for you and your customer, and the clean-up costs dwarf the value of the material many times over.
